Ricardo Tosto Comments on the New Civil Procedure Code

The Order of Brazilian Lawyers is celebrating the one-year anniversary of the new Code of Civil Procedure, which was passed in 2015 and went into effect last year. The new version of the code, which was spearheaded by the Order, has had a number of positive effects on the practice of law in Brazil.

One of the fundamental changes ushered in by the new code was the tightening up of rules concerning contingency fees. In the past, it was possible for clients to negotiate contingency fees with attorneys. However, the new Code of Civil Procedure now defines new minimums for attorneys handling cases on a contingency basis. In addition, minimum legal fees for various services were tightened up in the new version of the code in an effort to improve conditions for the profession.

The new civil procedure code is the first such code ever adopted entirely under democratic rule. As such, it represents a victory for the Brazilian profession and is a sign that Brazilian democratic institutions are maturing.
